Ce droit est r\u00e9gi par l\u2019article L. 271-1 du Code de la construction et de l\u2019habitation. Il accorde un d\u00e9lai de r\u00e9tractation de 10 jours \u00e0 l\u2019acheteur non professionnel, \u00e0 compter du lendemain de la remise en main propre ou de la r\u00e9ception de la notification de l\u2019acte sign\u00e9.<\/p>\n<p>Durant ce d\u00e9lai, l\u2019acheteur peut se r\u00e9tracter sans avoir \u00e0 justifier sa d\u00e9cision, ni \u00e0 subir de p\u00e9nalit\u00e9 financi\u00e8re. Pour cela, il doit informer le vendeur par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception. Si la notification est envoy\u00e9e dans le d\u00e9lai imparti, le contrat de vente est annul\u00e9, et les sommes vers\u00e9es, telles que le d\u00e9p\u00f4t de garantie, doivent \u00eatre int\u00e9gralement restitu\u00e9es.<\/p>\n<p>Ce d\u00e9lai de r\u00e9tractation ne s\u2019applique pas en revanche aux ventes r\u00e9alis\u00e9es entre professionnels ou \u00e0 d\u2019autres types d\u2019acquisition comme les terrains non b\u00e2tis.
